beware: choose your adviser carefully
At Incentur, we’re qualified chartered accountants and lawyers. Our team have held positions within both the Federal Government regulator and across the Big Four consultancies. Basically, we’re qualified to provide advice. Unfortunately, the ‘R&D adviser’ field itself is unregulated and can be treacherous.
As former program regulators, we frequently dealt with volume-focused advisers who submit mass numbers of applications, conscious that a percentage of them will likely fail at audit years after the benefits are paid. It’s a decades-old business model in this field. The adviser bears zero risk, audit defence is a separate (and often prohibitively high) fee, and only the applicant can be held liable by the regulator.
KNow the warning signs
- It's not simple and easy. If an advisor offers to prepare your claim based on a "single phone call" or questionnaire, this is recklessly inadequate and predatory.
- The R&D Tax Incentive is not a grant. Some advisers deceptively market the program as an "R&D grant". This is because grants are easy to sell. In truth, it's a tax offset that can be audited years later and clawed back with penalties.
- High volume advisers. Many advisers make embellished claims about preparing hundreds or even thousands of submissions per year. As former regulators, we saw the real numbers. We also frequently dealt with volume-obsessed advisers who, despite their marketing, were often careless and willing to lodge anything.
